These Terms & Conditions (“Terms”) govern your use of the website diwalispecialdeals (the “Site”) and any purchase you make from it. The Site is operated by Abhimanyu Rampersaud, trading as Diwali Special Deals, 15-2-73/2 Gowliguda Chaman, Hyderabad, Telangana 500012, India (“we”, “us”, “our”).
By using the Site or placing an order you agree to these Terms. If you do not agree, please do not use the Site.
1. Who can order
You must be 18 or older and resident in India to place an order. Orders can be delivered only to addresses within India. By ordering you confirm that the information you give is accurate and that you, or the person receiving the parcel, will be available to pay in cash on delivery.
2. Products and descriptions
We describe every product as accurately as we can, including material, size and count. Handmade items such as clay diyas and wooden rangoli sets vary slightly from piece to piece and from the photographs. Colours can look different on different screens. These variations are not defects.
Product images may show styling items (flowers, fabrics) that are not included unless the description says so.
3. Prices
All prices are in Indian Rupees (INR). We are not registered under GST, and no GST is charged or added. There are no delivery charges and no cash on delivery charges. The price shown on the product page at the time you place the order is the price you pay.
We may change prices at any time, but changes do not affect orders already confirmed. If a product is listed at an obviously wrong price because of an error, we may cancel the order and tell you before dispatch.
4. Placing an order
An order is placed when you complete checkout and receive an order number. We then confirm the order by SMS, WhatsApp or email. A contract of sale is formed when we dispatch the goods. We may decline or cancel an order before dispatch if:
- the pincode is not serviceable;
- the product is out of stock;
- the phone number cannot be reached to confirm the order;
- the address has a history of refused cash on delivery parcels;
- we suspect the order is fraudulent or placed by a reseller in breach of these Terms.
If we cancel, we tell you why.
5. Payment
The only payment method is cash on delivery. The full order amount is payable in cash to the courier at the time of delivery. Some couriers may accept UPI at the door, but this is not guaranteed. If payment is refused, the parcel is returned to us and the order is cancelled.
6. Delivery
Orders are dispatched from Hyderabad within one working day of confirmation and delivered in 5 to 7 days for most of India. Some regions take longer. Delivery times are estimates, not guarantees. Details are in the Shipping & Delivery Policy.
Risk in the goods passes to you when the courier hands over the parcel and payment is made. Please check the outer packaging before paying. If the parcel is visibly crushed or opened, you may refuse it and inform us.
7. Cancellations, returns and refunds
You may cancel before dispatch under the Cancellation Policy. Returns and refunds are handled under the Refund & Return Policy. Because payment is in cash, refunds are made by bank transfer or UPI to details you provide.
8. Safe use of products
Diyas, candles and incense involve open flame and should be used on a heat-resistant surface, away from fabric, and never left unattended. Electrical lights should be used as described on the product page and not left in direct rain. 9. Use of the Site and its content
The articles, photographs, descriptions and other content on the Site are ours or used with permission. You may read, print and share links to them for personal, non-commercial use. You may not copy articles or product descriptions to another website or sell products purchased here as our products without written permission.
You agree not to use the Site to place false orders, to scrape content, to interfere with its operation or to break any law.
10. Third-party links and advertising
The Site shows advertisements served by Google AdSense and may link to other websites. We do not endorse and are not responsible for the products, services or content of advertisers or linked sites. See our Advertising Disclosure.
11. Limitation of liability
To the extent permitted by Indian law, our liability for any claim arising from an order is limited to the price you paid for the product concerned. We are not liable for indirect losses such as a gift not arriving in time for an occasion, provided we dispatched within the stated time. Nothing in these Terms limits your rights under the Consumer Protection Act, 2019.
12. Complaints and grievance redressal
Our Grievance Officer page gives the name, contact and response times for complaints under the Consumer Protection (E-Commerce) Rules, 2020. You may also approach the consumer dispute redressal commission with jurisdiction over your area.
13. Governing law
These Terms are governed by the laws of India. Subject to your rights under consumer law to file a complaint where you live, courts in Hyderabad, Telangana have jurisdiction.
14. Changes to these Terms
We may update these Terms. The version in force when you place an order applies to that order. The date at the top shows the latest revision.
